Welcome to TopCards. These Terms of Service (the “Terms”) govern your access to and use of the topcards.com.ua website and all related services provided by TopCards.

By using our website or ordering any of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. General Provisions

1.1. TopCards provides digital services related to the creation, design, and publication of product cards, texts, descriptions, and SEO content for marketplaces.
1.2. All materials available on the website, including texts, images, and design elements, are the intellectual property of TopCards and are protected by applicable copyright laws of Ukraine.
1.3. We reserve the right to modify or update these Terms at any time without prior notice. The updated version becomes effective immediately upon publication on the website.

2. Services

2.1. All TopCards services are digital and do not include any physical delivery.
2.2. Once the service process has begun (for example, the creation of content, product cards, or SEO optimization), refunds are not available, except in cases of technical error or inability to fulfill the order on our part.
2.3. Service scope, price, and delivery time are defined individually and clearly stated on the relevant service page or agreed upon directly with the client.

3. Payments

3.1. Payment for services is made through secure payment systems provided by Shopify or other trusted methods available on the website.
3.2. All prices are listed in Ukrainian hryvnias (UAH), unless otherwise specified.
3.3. Once the payment is confirmed, the order is considered accepted for execution.
3.4. The client is responsible for providing accurate payment information.

4. Responsibilities

4.1. We guarantee that our services will be performed in accordance with the provided description and agreed technical specifications.
4.2. TopCards is not responsible for:

  • Errors caused by incorrect or incomplete data provided by the client;

  • Changes in marketplace rules or moderation policies;

  • Interruptions or errors caused by third-party services (payment providers, hosting, internet connection, etc.).
    4.3. The client agrees not to use the TopCards website or services for illegal activities, malicious actions, or infringement of third-party intellectual property rights.

5. Intellectual Property

5.1. All materials created within the scope of our services (texts, product cards, descriptions, etc.) become the property of the client after full payment.
5.2. TopCards does not use client materials for commercial purposes without explicit consent, except for portfolio or demonstration purposes.
5.3. All mentioned trademarks and logos belong to their respective owners.

6. Limitation of Liability

6.1. The website and its content are provided “as is”, without any warranties of any kind.
6.2. TopCards does not guarantee uninterrupted or error-free operation of the website.
6.3. In the event of technical failures, we will make every reasonable effort to resolve them promptly.

7. Privacy

7.1. All personal data collected from clients is processed in accordance with our Privacy Policy.

8. Governing Law

8.1. These Terms are governed by the laws of Ukraine.
